MFDA Technology Webinar Series: Legal Aspects of Cybersecurity and Cyber-Risk Management


As part of the MFDA Technology Webinar Series, the MFDA will host a session with Borden Ladner Gervais LLP (“BLG”) on Tuesday, March 9, 2021 at 1pm (ET). Ira Nishisato and Dan Michaluk, Partners at BLG, will discuss legal duties and potential liabilities arising out of privacy and security breaches. The standard of care applicable to MFDA Members, Approved Persons and others handling confidential information such as client data will be considered, as well as the legal requirements for dealing with both insider threats and external breaches, including recent changes to Canadian law concerning mandatory breach notification. Ransomware will be discussed as a particular challenge that has become increasingly common. The practical aspects of cybersecurity, including the current threat landscape and tips for responding to data breaches, will also be considered.
